AGREEMENT TO OUR LEGAL TERMS
We are Kibbi Technologies Inc., doing business as Kibbi ("Kibbi," "Company," "we," "us," "our"), a company incorporated in Alberta, Canada.
We operate the websites https://www.mykibbi.com and https://www.mykibbi.ca (together, the "Site"), the mobile application Kibbi: Canada's Job Search App (the "App"), and any co-branded or white-labeled career platforms we operate on behalf of professional associations and other partner organisations (each, a "Partner Platform"), together with any related products and services that link to these Terms of Use (collectively, the "Services").

These Terms of Use are a binding agreement between you — whether you are using the Services as an individual seeking employment (a "Job Seeker"), as an organisation posting jobs or searching for candidates (an "Employer"), or otherwise — and Kibbi Technologies Inc. ("you"). By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms of Use. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICES.
Kibbi is a job search and hiring platform. Kibbi is not an employer, staffing agency, recruiter, or employment agency, and Kibbi is not a party to any employment, contracting, or hiring relationship formed between a Job Seeker and an Employer. Section 15 and Section 19 below explain what this means for you.
If you are accessing the Services through a Partner Platform, your use of that Partner Platform's branding, and the commercial relationship between Kibbi and the partner organisation, is governed by a separate written agreement between Kibbi and that organisation (see Section 21). These Terms of Use still govern your individual use of the underlying Kibbi Services.
We will give you reasonable prior notice of material changes to these Terms of Use, either by posting on the Services or by email to the address on your account. Continuing to use the Services after a change takes effect means you accept the revised terms.
The Services are intended for use by individuals who are at least 18 years old, and by authorized representatives of Employers and Partner organisations. See Section 2 for details.
We recommend you keep a copy of these Terms of Use for your records.

PART I — TERMS THAT APPLY TO EVERYONE
1. OUR SERVICES
Kibbi connects Job Seekers with Employers through job listings, candidate profiles, and related tools, including on Partner Platforms operated for professional associations and similar organisations. The Services are not directed at, and should not be used by, anyone in a jurisdiction where doing so would violate local law. If you access the Services from outside Canada, you are responsible for complying with the laws that apply to you where you are.
2. ELIGIBILITY
You must be at least 18 years old to create an account or otherwise use the Services. If you are registering on behalf of an Employer or a Partner organisation, you additionally represent that you are authorized to bind that organisation to these Terms of Use.
Kibbi does not verify a Job Seeker's legal eligibility to work in Canada or any other jurisdiction, and does not verify an Employer's authorization to employ workers. You are solely responsible for confirming your own work eligibility, and Employers are solely responsible for confirming a candidate's eligibility to work, before entering into any employment relationship.
3. ACCOUNTS AND REGISTRATION
You may need to register for an account to use some or all of the Services. By registering, you represent and warrant that: (a) all information you submit is true, accurate, current, and complete, and you will keep it that way; (b) you have the legal capacity to agree to these Terms of Use; (c) you meet the eligibility requirements in Section 2; (d) you will not access the Services using bots, scrapers, or other automated means; and (e) your use of the Services will comply with all applicable law.
You are responsible for keeping your password confidential and for all activity on your account. Tell us immediately at support@mykibbi.com if you suspect unauthorized use of your account. We may remove, reclaim, or ask you to change a username or organisation name that we reasonably consider inappropriate, misleading, or otherwise objectionable.
If any information you give us turns out to be untrue, inaccurate, outdated, or incomplete, we may suspend or terminate your account.
4. INTELLECTUAL PROPERTY RIGHTS
Our intellectual property
We own or licence all intellectual property rights in the Services, including the source code, databases, functionality, software, designs, text, and graphics (the "Content"), as well as the Kibbi name, logo, and related marks (the "Marks"). Our Content and Marks are protected by copyright, trademark, and other intellectual property laws in Canada and internationally, and are made available "AS IS" for your personal, non-commercial use, or for your organisation's internal business use in connection with the Services.
Your licence to use the Services
Subject to your compliance with these Terms of Use, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and to download or print Content you have properly accessed, solely for personal, non-commercial use (Job Seekers) or internal business use in connection with your use of the Services (Employers and Partners).
Except as set out here, no part of the Services, Content, or Marks may be copied, reproduced, republished, distributed, sold, or otherwise commercially exploited without our prior written permission. Contact legal@mykibbi.com to request permission for any other use. We reserve all rights not expressly granted to you.
Your submissions and contributions
If you send us feedback, suggestions, or ideas about the Services ("Submissions"), you agree that we may use them freely, without any obligation to you, to improve or operate the Services. Please don't send us anything you consider confidential.
If the Services let you post, submit, or otherwise share content — such as a candidate profile, resume, job posting, or comment (collectively, "Contributions") — Section 6 explains what rights you keep and what rights you give us.
5. PROHIBITED ACTIVITIES
You may only use the Services for their intended purpose: helping Job Seekers find work and helping Employers find candidates, in each case as described in Parts II and III below. You agree not to:
Nothing in this section prohibits an Employer from posting job opportunities, or a Job Seeker from applying to them — that is the intended use of the Services. Section 18 sets out the standards that apply specifically to job postings.
6. USER-GENERATED CONTENT AND CONTRIBUTION LICENCE
When you post a Contribution (such as a profile, resume, job listing, comment, or review), you represent that: it is accurate and not misleading; you own it or have the right to share it; it does not infringe anyone's intellectual property, privacy, or other rights; and it complies with these Terms of Use and applicable law, including that it is not unlawful, discriminatory, harassing, hateful, obscene, or defamatory.
You keep ownership of your Contributions. To let us operate the Services, you grant Kibbi a non-exclusive, worldwide, royalty-free, sub-licensable licence to host, store, reproduce, display, and distribute your Contributions solely as needed to: (a) operate and provide the Services to you, including displaying a candidate profile to Employers or a job posting to Job Seekers; (b) operate a Partner Platform on which your Contribution appears; and (c) maintain backups, ensure security, and comply with law.
We will not sell your resume, profile, or other Contributions to third parties, and we will not use your name, photo, or Contributions in external advertising or marketing without your separate, specific consent. You may delete a Contribution, or your account, at any time, and we will stop actively displaying that Contribution to other users, subject to our data retention practices described in our Privacy Policy and any residual copies retained in routine backups.
We may remove or edit a Contribution at any time, without notice, if we reasonably believe it violates these Terms of Use, and we may suspend or terminate the associated account. We are not obligated to monitor Contributions, and we are not responsible for the accuracy of any Contribution posted by another user.
7. GUIDELINES FOR REVIEWS
If the Services let you post a review or rating, you must have firsthand experience with what you are reviewing, and your review must not contain hateful, discriminatory, obscene, or knowingly false content, or references to illegal activity. We may accept, reject, or remove reviews in our discretion, and reviews reflect the views of the poster, not Kibbi.
8. MOBILE APPLICATION LICENCE
If you access the Services through the App, we grant you a revocable, non-exclusive, non-transferable, limited licence to install and use the App on a device you own or control, for your personal or organisational use of the Services. You agree not to: reverse-engineer or decompile the App except as permitted by law; modify or create derivative works of the App; use the App for any purpose it isn't designed for; make the App available to multiple users on a shared basis; or use the App to send unsolicited communications.
If you obtained the App through the Apple App Store or Google Play, the applicable store's standard terms of service also apply, and that store is a third-party beneficiary of this section, entitled to enforce it against you. Kibbi, not the App store, is responsible for providing support for the App.
9. THIRD-PARTY WEBSITES AND CONTENT
The Services may contain links to third-party websites or third-party content, including links or materials appearing in job postings, employer profiles, articles, blogs, videos, resources, or other content made available through the Services. Kibbi does not control or assume responsibility for third-party websites or content, and the inclusion of a link does not mean that Kibbi endorses the third party or its content. If you leave the Services to access a third-party website, you do so at your own risk and these Terms of Use no longer apply to your use of that third-party website.
Kibbi also provides white-label and partner-branded platforms that enable participating organisations and their authorized users to publish, upload, curate, distribute, and share content with their audiences. This may include articles, blogs, videos, resources, announcements, promotional materials, advertisements, employer content, and other materials.
Partners determine what content they choose to publish or make available through their branded platform and are responsible for ensuring that such content is accurate, lawful, appropriate, and that they have all necessary rights, permissions, and consents to publish or distribute it. Unless expressly stated otherwise, content published by a partner or its authorized users represents the content of that partner or user and should not be understood as content created, approved, or endorsed by Kibbi.
10. ADVERTISERS
The Services may include advertising, sponsorships, promotional content, featured content, or other marketing materials provided or selected by partners, employers, advertisers, or other third parties.
Kibbi provides the technology and functionality that enables this content to be displayed or distributed. Where a partner manages a white-label or partner-branded platform, the partner may determine which advertising, sponsorship, promotional, or other content appears within its platform.
The party that provides, publishes, or selects such content is responsible for the content and for ensuring that it complies with applicable laws, regulations, contractual obligations, and any required advertising or disclosure standards. Unless expressly stated otherwise, the presence of advertising or promotional content on the Services does not constitute Kibbi’s endorsement of the advertiser, its products or services, or the claims made in the content.
11. SERVICES MANAGEMENT
We may, but are not obligated to: monitor the Services for violations of these Terms of Use; take action, including legal action, against anyone who violates them; restrict, disable, or remove Contributions that violate these Terms of Use; and otherwise manage the Services to protect Kibbi, our users, and the proper functioning of the platform.
12. PRIVACY POLICY
We care about your privacy. Our Privacy Policy (https://www.mykibbi.com/privacy-policy/) explains how we collect, use, and disclose personal information, and is incorporated into these Terms of Use. As a Canadian company, we handle personal information in accordance with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and Alberta's Personal Information Protection Act (PIPA), as applicable. The Services are hosted in Canada; if you access them from another jurisdiction, you consent to your information being transferred to and processed in Canada.
13. COPYRIGHT INFRINGEMENT NOTICES
We respect others' intellectual property. If you believe material on the Services infringes your copyright, notify us at legal@mykibbi.com with enough detail for us to locate the material and evaluate your claim. We will forward a copy of your notice to the person who posted the material. Knowingly misrepresenting that material is infringing may expose you to liability.
PART II — TERMS FOR JOB SEEKERS
This Part II applies when you use the Services to search for, or apply to, employment opportunities as an individual ("Job Seeker").
14. USING KIBBI AS A JOB SEEKER
Creating a Job Seeker account and browsing or applying to jobs is free. You're responsible for the accuracy of your profile, resume, and any information you submit in an application — don't misrepresent your identity, qualifications, or work history. You decide which Employers can see your profile and application materials, and you're responsible for your own communications, interviews, and any offer or agreement you reach with an Employer.
15. NO GUARANTEE OF EMPLOYMENT; WE ARE NOT YOUR EMPLOYER OR AGENT
Kibbi is a platform that helps Employers and Job Seekers find each other. We are not an employer, employment agency, staffing agency, or recruiter, and we do not make hiring decisions, extend job offers, or act as an agent for any Job Seeker or Employer. We do not guarantee that you will receive interviews, offers, or employment through the Services, and we do not guarantee the accuracy of any job posting or the legitimacy, existence, conduct, or reliability of any Employer.
Any employment, contracting, or other relationship you enter into with an Employer is exclusively between you and that Employer, and is governed by whatever terms you and the Employer agree to. We encourage you to independently verify any Employer and job opportunity before sharing sensitive personal information or accepting an offer, and to report suspicious postings to legal@mykibbi.com.
Job seekers are responsible for exercising caution when applying for jobs through the platform. While we make reasonable efforts to provide a useful and reliable job board, we do not independently verify or guarantee the identity, legitimacy, or business status of every employer or job posting.
Before applying, job seekers are encouraged to research the employer independently and confirm that the business and job opportunity are legitimate. Be cautious of employers or individuals who:
If a job opportunity appears suspicious or fraudulent, do not provide money or personal information. Job seekers should report suspicious postings or activity to us so that we can review the matter and take appropriate action.
By using the platform, job seekers acknowledge that they are responsible for conducting their own due diligence before applying for or accepting employment and that we cannot guarantee the legitimacy of every employer, job posting, or employment opportunity.
16. THE TALENT DIRECTORY
Kibbi or a Partner Platform offers a Talent Directory or similar searchable database of candidate profiles, your profile is made visible to Employers according to the visibility level you choose. We ask you to set your visibility preference during sign-up, and you can change it at any time in your account's profile settings. Your options are: visible within the Talent Directory only; visible more broadly across the Kibbi platform; restricted to an Employer you are actively applying to or engaging with; or removed from search and directory visibility entirely. See our Privacy Policy for how we handle your information at each visibility level.
PART III — TERMS FOR EMPLOYERS
This Part III applies when you use the Services to post job opportunities, search candidate profiles, or otherwise recruit as an organisation or on behalf of one ("Employer").
17. USING KIBBI AS AN EMPLOYER
By posting a job or otherwise using the Services as an Employer, you represent that you are authorized to recruit and hire on behalf of the organisation named in your posting, and that the organisation has, or will have, the legal authority to employ or engage workers in the jurisdiction where the position is located. You're responsible for keeping your organisation's account information (including billing contacts) current.
18. JOB POSTING STANDARDS
Every job posting and all related content you submit must be truthful, accurate, and current, and must comply with all applicable law, including employment standards, human rights, and privacy law in the jurisdiction where the position is located. Without limiting the foregoing, you agree that your postings and use of the Services will not:
We may reject, edit, or remove any job posting, and may suspend or terminate an Employer account, that we reasonably believe violates this section, without notice.
19. EMPLOYER RESPONSIBILITY FOR HIRING DECISIONS
You are solely responsible for your job postings, your recruiting and hiring decisions, and your compliance with all laws that apply to those decisions, including employment standards, human rights, immigration, and privacy law. This includes verifying a candidate's identity, qualifications, and legal eligibility to work, and conducting any background checks you consider necessary — Kibbi does not perform these checks on your behalf and does not vouch for any Job Seeker. Kibbi is not a party to, and has no liability arising from, the employment or contracting relationship between you and any candidate you find through the Services.
20. FEES, PAYMENT, AND SUBSCRIPTIONS
Job Seeker accounts are free. Employers pay for job postings, subscriptions, or sponsorship packages as described on the Site, in your order form, or in your invoice. All fees are in Canadian dollars unless stated otherwise, and applicable taxes will be added. We accept the payment methods made available at checkout, or payment by invoice for enterprise and Partner-linked accounts, as agreed with you.
You agree to provide accurate billing information and keep it current. By subscribing, you authorize us (or our payment processor) to charge your payment method for the applicable fees, including recurring charges for any subscription, until you cancel. You can cancel a self-serve subscription at any time through your account; cancellation takes effect at the end of the current paid term, and fees already paid are non-refundable except as required by law or as we otherwise agree in writing. Where we offer a free trial, your payment method will be charged for the applicable subscription at the end of the trial unless you cancel first.
We may change our fees from time to time. For subscriptions, we'll give you reasonable notice before a price change takes effect for your next billing cycle. Enterprise and Partner-linked arrangements are governed by the pricing and payment terms in the applicable order form or agreement, which control over this section in the event of a conflict.
We reserve the right to correct pricing errors, and to refuse, limit, or cancel an order in our reasonable discretion, including where we suspect fraud or abuse.
PART IV — TERMS FOR PARTNER ORGANISATIONS
21. PARTNER AND WHITE-LABEL PLATFORMS
Kibbi partners with professional associations and similar organisations ("Partners") to operate co-branded or white-labeled career platforms. If your organisation is a Kibbi Partner, the licensing, branding, revenue-sharing, data, and other business terms of that relationship are governed by a separate written agreement between your organisation and Kibbi (a "Partner Agreement"), not by these Terms of Use. These Terms of Use continue to govern the individual use of the Services by your organisation's staff, members, and any Job Seekers or Employers using your Partner Platform. If there is a conflict between a Partner Agreement and these Terms of Use on a matter the Partner Agreement addresses, the Partner Agreement controls. PART V — GENERAL LEGAL TERMS
22. TERM AND TERMINATION
These Terms of Use apply for as long as you use the Services. We may suspend or terminate your access to the Services, or remove your account or Contributions, at any time, for any lawful reason — including a breach of these Terms of Use — with or without notice, in our discretion. If we terminate your account for cause, you may not open a new account under your name, a false name, or on behalf of a third party.
23. MODIFICATIONS AND INTERRUPTIONS
We may change, update, or discontinue features of the Services at any time. We don't guarantee the Services will always be available or error-free, and we aren't liable for any loss caused by downtime, interruptions, or discontinuation of the Services. Nothing here obligates us to maintain, support, or continue offering any part of the Services.
24. GOVERNING LAW
These Terms of Use are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law rules.
25. DISPUTE RESOLUTION
Informal resolution first
If a dispute arises between you and Kibbi relating to these Terms of Use or the Services, we agree to first try to resolve it informally. Either party can start this process by giving the other written notice describing the dispute. We'll both make a good-faith effort to resolve the dispute within 30 days of that notice.
Courts
If a dispute isn't resolved informally, it will be brought exclusively in the courts of Alberta, and you and Kibbi each submit to the exclusive jurisdiction of those courts. This section does not limit either party's right to seek injunctive relief, or to bring a claim relating to intellectual property rights, in any court of competent jurisdiction.
26. CORRECTIONS
The Services may contain typographical errors or inaccuracies, including in job postings, pricing, or descriptions. We may correct these and update the Services at any time without notice.
27. DISCLAIMERS
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the accuracy or completeness of any content on the Services, including job postings or candidate profiles, and we are not responsible for: (a) errors or inaccuracies in content; (b) personal injury or property damage resulting from your use of the Services; (c) unauthorized access to our servers or to personal or financial information stored there; (d) interruptions in transmission to or from the Services; or (e) viruses or other harmful code transmitted through the Services by a third party. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above limits may not apply to you.
28. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Kibbi, our directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profit, revenue, or data, arising from your use of the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms of Use or the Services will not exceed the greater of (a) the amount you paid to us in the three (3) months before the claim arose, or (b) CAD $100. Some jurisdictions do not allow certain limitations on liability, so some or all of the above limits may not apply to you, and you may have additional rights.
Nothing in these Terms of Use limits either party's liability for gross negligence, wilful misconduct, or anything else that cannot be limited under applicable law.
29. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Kibbi and our officers, directors, employees, and agents from any third-party claim, loss, liability, or expense (including reasonable legal fees) arising from: (a) your Contributions; (b) your use of the Services; (c) your breach of these Terms of Use; (d) your violation of a third party's rights, including intellectual property or privacy rights; or (e) for Employers, your job postings or your recruiting and hiring decisions. We'll give you reasonably prompt notice of any claim subject to this section, and we may assume control of its defence at your expense; you agree to cooperate with us.
30. USER DATA
We maintain certain data you transmit to the Services to operate and support them. While we perform routine backups, you're responsible for maintaining your own copies of anything important to you, and we aren't liable for loss or corruption of data except as required by law.
31. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
Using the Services, or emailing us, counts as electronic communication. You consent to receive communications from us electronically, and agree that electronic agreements, notices, and records satisfy any legal requirement that they be in writing, to the extent permitted by applicable law, including Alberta's Electronic Transactions Act.
32. SMS TEXT MESSAGING
If you opt in to receive SMS messages from us, you can opt out anytime by replying "STOP" — we may send a confirmation message. Standard message and data rates from your carrier may apply. Questions about our SMS communications can be sent to legal@mykibbi.com or (+1) 403-899-2220.
33. MISCELLANEOUS
These Terms of Use, together with our Privacy Policy and any Partner Agreement or order form that applies to you, are the entire agreement between you and Kibbi regarding the Services. If we don't enforce a right under these Terms of Use, that's not a waiver of it. We may assign these Terms of Use, including in connection with a merger or sale of our business. If a provision of these Terms of Use is found unenforceable, the rest remain in effect. Using the Services doesn't create a partnership, joint venture, employment, or agency relationship between you and Kibbi.
